Walmart’s flipkart had challenged a rating last week about the Karnataka High Court which allowed the Indian Competition Commission (CCI) to continue his investigation into the company in the Division bench. Amazon’s advice also asked the problem to be marked along with the flipkart appeal. Requests have been received.
“This is urgent for them if not, CCI can take action against them. They need to stay to stop the investigation. The request for this problem is to be heard tomorrow,” someone who persecuted a development.
On June 11, the Karnataka High Court rejected the Amazon and Flipkart Writ application to allow CCI to continue the probe.
The problem began almost 18 months ago when Delhi Vyapar MahasangH (DVM), a group representing small and medium enterprises in the national capital, submitted a request with CCI against the two largest e-commerce players in the country, accused them of anti-competitive. Practice, predator prices and preferential treatment of sellers, among others.
DVM filed complaints below section 3 and 4 of the competition law.
CCI sent an order in January 2020 based on information submitted by DVM below Section 3, directed the Director General to conduct an investigation.
This order was challenged by Amazon through a direct petition in the Karnataka High Court in February 2020. The High Court placed CCI investigation in the same month.
Meanwhile the Confederation of all Indian traders (CAIT) said it was ready to oppose the petition in court.
“No doubt we will oppose it. We are just waiting for a copy of the petition. We will go through content to see what reasons they submit it,” said Praveen Khandelwal, Secretary General of National Cait.
“Injuries that cannot be improved will be caused by the applicant if the investigation will continue to wait for the current appeal,” Flipkart filing, which is not published but has been seen by Reuters, said. It also urged the court to cancel the initial CCI command for investigation.
Amazon has installed similar challenges, two sources familiar with the problem. Both tend to be heard by the two-judge panels this week, said the source.
Flipkart and CCI did not immediately respond to Reuters’s comment requests. Amazon refused to comment on his appeal.
The source told Reuters this week that CCI planned to accelerate investigations because it increased the supervision of large technology companies. CCI plans to demand information from Flipkart and Amazon on charges of “as soon as possible”, said one source. Such investigations usually run a few months.
In September 2020, CCI challenged the temporary order in the Supreme Court. Justice Nageswara Rao sent the case back to the High Court, said the case was heard as soon as possible on October 2020.
After hearing months, the Karnataka High Court has given its judgment to support CCI.
